DENVER, September 26, 2012, (LifeSiteNews.com) – A judge’s order will not stop the Obama administration from pressing forward in its quest to punish a Catholic family’s business for refusing to comply with the HHS mandate.
Hercules Industries, an HVAC business in Denver, won an injunction against the controversial provision requiring employers to cover contraceptives, sterilization, and abortion-inducing drugs in its health care plans on July 27.
On Tuesday, the Justice Department appealed the ruling to the Tenth Circuit Court of Appeals, also based in Denver.

Pray that Hercules Industries is victorious

This administration is out of control in its views on religious freedom. This admin has got to go on November 6th

Catholic business owners take aim at birth control mandate in Detroit federal court
A Catholic legal group says parts of President Obama’s health care law violate their clients’ religious freedom.
Representatives for the Thomas More Law Center made their arguments on behalf of business owners in a Detroit federal court Friday.
The groups charge that they shouldn’t have to provide employees with health insurance that includes contraception coverage—the so-called “HHS mandate”-- in violation of their first amendment rights.
John Hunt is the Executive Director of Ligatus, an organization representing Catholic business executives and a plaintiff in the case.
“We, as individual Catholics who are leading and managing our businesses, we’re being forced to provide services to our employees that are completely contrary to the teachings of our Catholic faith," Hunt said.
Government lawyers argued there are “layers of legal separation” between a company and its owners, and “collapsing” that distinction would allow business owners to challenge all kinds of laws on first amendment grounds.
They maintain the government has a “compelling public interest” to mandate birth control coverage and other preventative women’s health services. They argued doing so does not violate an individual business owner’s religious freedoms.
But Erin Mersino—who argued the case on behalf of the Ann Arbor-based Thomas More Law Center—says that argument is “simply not realistic.”
“To adopt the government’s argument, it would be to say that you have religious freedom within your own home, but if you engage in any sort of business activity, that you give up that religious freedom,” said Mersino.
The plaintiffs are asking for a preliminary injunction against the mandate.

Hm… I wonder what will happen with the other corporations that challenged the mandate, will the DOJ block their gains also?

How any Catholic can vote for this man…😦
The appeal is automatic, it’s how these things get to the Supreme Court. Y’all do want the Court to rule, right? While the Catholics are a majority on the bench?

Obama isn’t sitting around in the White House saying, “I’ll show those guys in Denver who’s boss!” It’s automatic, the US Attorney General is mandated to represent the government, meaning the People of the United States vs … the guys in Denver.

The President is responsible for what his administration does, or does not do under his leadership. If he wished to, he could acquiesce to the court ruling and not appeal. He has chosen not to do that and instead, is doubling down.

Yah. No kidding. I will never get how people expect members on this forum would not know such things.

If Obama and a lot of Democrats are not voted out of office this November I truly do fear what may be in store for us Catholics in the future. I fear we may be facing much more persecution and oppression than what is going on even now.

Obama has doubled down on the HHS mandate
Speaking to a Louisiana reporter, President Obama claimed that his HHS Mandate forcing people to cover abortion-inducing drugs and contraception applies to “big Catholic hospitals or universities who employ a lot of non-Catholics and who receive a lot of federal money.”
This is a false statement. There is no requirement in the Mandate that an entity “receive a lot of federal money,” or any federal money at all, to have its conscience violated. The Mandate applies even if you get zero “federal money.” There is absolutely no connection between the HHS Mandate and federal money. The president’s statement gives the incorrect impression that the Mandate is a string attached to federal money, when in fact it applies just because an entity is in America.
In fact, for 40 years Congress has made it clear that even if Catholic entities get federal money, that does not justify violating their consciences. The president promised to honor that principle when ObamaCare passed, but apparently now he thinks getting federal money provides him a license to attack conscience. In any event, the HHS Mandate has nothing at all to do with getting federal money.

Just like the Department of Justice defends the Defense of Marriage Act (DOMA), right? Obama picks and chooses his battles in line with his radical ideology.

Of course it’s not automatic,
This implies every case then would funnel to SCOTUS for review

First, remember the business was only given a “TEMPORARY injunction” that prevents punishment while their lawsuit is waiting to be heard.

The DOJ could have left them alone until the lawsuit is heard, or the DOJ could have responded to the 'Temporary Injunction" as the Judge requested
Judge Kane, … instructed the Obama administration it must “demonstrate that there are no feasible less-restrictive alternatives.”

“The government need not tilt at windmills; it need only refute alternatives proposed by Plaintiffs,” he wrote in his decision.

Actually, Jason, the President doesn’t have the authority to stop the Attorney General of the United States from defending the laws that Congress passes. The President cannot make law, nor repeal law. He can’t interfere in due process except in his ability to pardon. What’s actually doing is sitting out.

So let’s review the action: Congress passes a law. People object to the law or parts thereof. Congress has the ability to alter or rescind all or part of that law. This Congress is the most Republican we’ve had for a while. It’s their job. It was always their job.

Stop blaming Obama for what a Republican Congress made law and refused to change. The appeal is automatic. It’s the job of the AG to do what he is doing, he is required to. It is not legal for the President to interfere.

If you believe that to be reality, then you are not paying attention. cbsnews.com/8301-503544_162-20035398-503544.html

First, putting your font in very large and bold like you did is the equal of yelling at me on a forum and is very rude. Please stop.

Second, appeals are not automatic. They must be filed and the decision must be made to do so. Holder works for Obama. If Obama did not wish the appeal to be filed, it would not be. The executive branch of government could conclude that in the short term, the judicial branch has spoken and go from there. They did not. The chose to file and appeal.

Third, are you honestly suggesting that a republican congress passed Obama Care under which the HHS Mandate was created? Seriously? Obama Care did not earn a single republican vote, and was passed through a parliamentary trick under democratic control in both houses.

30 repeal attempts = refused to change?

Where are you coming up with this stuff?

NO, it is not automatic to appeal a temporary injunction.
And you are being foolish if you believe the DOJ always enforces the law, or is independant of Obama.

To jog your memory, think of the immigration laws on the books, but ignored by DOJ.
In fact, DOJ has gone the other direction, and is targeting AZ for their attempts to follow law.

Another example, President Obama has instructed the Justice Department to stop defending the constitutionality of the Defense of Marriage Act.

Example of not enforcing voting laws
pjmedia.com/blog/lawlessness-at-the-doj-voting-section-told-not-to-enforce-purging-the-dead-or-ineligible-from-voting-rolls/

The Attorney General is a political appointment on his cabinet. While it must be approved by congress, only a fool doesn’t recognize his role is to support the Presidents objectives, within the law. Most of the DOJ senior positions are political appointments.
