Am I considered living in sin?

I was married through the Catholic church twenty years ago, the marriage ended in divorce and I was granted a annulment. I am single but in a relationship and my partner lives with me. We are considering marriage but he does not practice or follow any religion.

My question is, if we were to marry by a civil marriage am I considered living in sin?
 
Dear friend,

If you are having sexual relations with him, you are already living in the state of mortal sin. If you marry outside of the Catholic Church, you will commit yet another mortal sin by that fact—plus every time you have sexual relations with him.

I suggest that you see a priest about marrying in the Church, or else,separate and look for a believer for a spouse. You are in our prayers.
