Annulment Process for Non-Catholic Wedding

A friend of mine was married to a non-Catholic who attends the Jubillee Church here in San Jose, CA. They were married by a pastor at this Jubillee Church.She is now divorced and would like to know if she needs to get an annulment knowing that she was not married in the Catholic Church.

Please let me know what to advise her.

She should contact her parish priest to be 100% sure.

Assuming she is Catholic, and was married outside of the Church without a Dispensation from the Bishop, she may qualify for what is called “Defect of Form”. These usually only take a few weeks to complete.

Again, the best place to start is with the Parish Priest. You are going to get a variety of answers with “what if’s”, and “did they?”, etc.

Your friend needs to make an appointment with her pastor at the local Catholic Church and lay out all the facts.

She must be declared free to marry, whether she applies for a decree of nullity, defect of form, or something else will depend upon the specifics she shares with her pastor.

This post confused me! If a Catholic marries outside of the Church, without explicit permission, then no marriage has taken place. An attempt at marriage has been made, but there was never a true marriage. So this woman needs to go and see her priest and lay out the whole situation, and see what she needs to do next.
