Annulment Question

Hello. I am currently getting an annulment from my ex. I have a couple questions. If he objects, does he have to provide something to substantiate his objections? Also, what happens if he does object?

He is now married with a baby. They were married in a civil ceremony and he goes to another church. An annulment would annul the marriage for both of us I know. My question is, is his marriage now valid? Will it be valid when our annulment goes through? Would he have to be remarried in a Catholic ceremony for it to be valid in the Catholic church?

Thanks, this has been a difficult experience for me, therapeutic, but difficult all the same.

It may be semantics, but you’re not getting an annulment…you’ve petitioned for one.

No one really gets a chance to “object”, per se. Both you and he will be asked for your statements. You’ll both be asked to provide witnesses who will give their statements. The statements may be written or oral, depending on your Tribunal.

The marriage is assume valid until proven invalid. So the Church assumes that you and he are still married right now.

Praying for you…I know what you mean by difficult and therapeutic…I went through the petition process recently.

He cannot “object” to the marriage being declared null or void. He may be sent papers to answer questions about your marriage to him which the tribunal will look at- and the side defending the marriage of course would take into consideration anything he would say concerning it that would give evidence to the possible authenticity of the marriage. An annulment is not the equivalent of a divorce where you can object to it- there is already an objection made by the Church against the invalidity and the attourneys for the “validity” argue in favor of the marriage while attourneys for “invalidity” so to say argue against it. Your husband cannot object to anything- and I seriously doubt that he would even know what to say to give evidence of the validity of the marriage.

As far as the “marriage” he is involved in now-

If he is Catholic and the ceremony was not witnessed by a priest or deacon anyway so in the eyes of God and the Church the marriage he is currently in is invalid. In order for his now marriage to be valid he would have to, after the annulment, go to confession and have the marriage he is now convalidated. Since he has obviously left the Catholic Church that would be almost impossible. My father is currently in the same situation- he now attends a Baptist church- please pray for him.
