My husband was divorced 40 years ago. We have been happily married for 37 years. We have received an invitation to be trained as Ministers of Communion. Are we legally allowed to accept this invitation?

Divorce, in and of itself, does not preclude someone from becoming an Extraordinary Minister of Holy Communion. Marriage outside the Church does.

If you and your husband were able to marry in the Church or have your marriage validated in the Church, then you both are eligible to serve as an EMHC.

If you the two of you were married outside the Church then you both would be ineligible until you had the marriage validated.
