Challenge to abortion and Supreme Court

DENVER, December 18, 2007 (LifeSiteNews.com) - A young law student in Colorado has launched an effort to put a resolution on the state ballot in 2008 to acknowledge the personhood of embryos from the moment of fertilization.

Although the Illinois law proves that a state can successfully define an embryo as a child, while doing nothing to eliminate or even limit abortion,** lawyers at the Thomas Moore Law Center are optimistic about the implications for the right to life if such initiatives are passed, speculating that they might become a Supreme Court test case that could even overturn Roe v. Wade and Doe v. Bolton, the two decisions that struck down anti-abortion laws in the early 1970s.**

Robert Muise of the Thomas More Law Center says that he “can’t think of a better time than right now to bring the issue forward. ** I think the Supreme Court as currently constituted would say ‘leave it to the states’”.**

On the federal level, Congress has HR-1094, the “Sanctity of Life Act of 2007.”

This bill would not only define that human life exists from conception (like the state-level attempts mentioned here,) but also would limit the jurisdiction of any federal courts from ordering the states to allow abortion if they chose not to.

Passage of this bill would require a 51% majority in Congress and a presidential signature, a FAR easier task than either a constitutional amendment OR a supreme court roll of the dice.

It would be nice if the Supreme Court would recognize that human life begins at conception but I unfortunately don’t see that happening any time soon.

Yes after year I have watch the “Sanctity of Life Act” receive little notice in Congress. They are introduced and that’s it.

The Supreme Court is much more Prolife today. Depending on Justice Kennedy’s vote, the Court may confirm that life begins at conception.

the State of Ga is thinking of placing a constitutional amendment on the ballet for 08. I think GA state house and senate is set to vote on in in Jan. However many pro life groups are opposed to it
