Is it mortal, even if you don’t sin?

Situation: there was a commercial on TV that I’d seen before and I knew contained a sexually explicit moment in it. When it came on again I looked away, but heard part of the sexually explicit part. I controlled my thoughts and actions, but now I am not sure if I was TRYING to hear that sequence. If it did, would it be mortal?
I am also wondering–do you have to say in your mind, “this is a mortal sin, but I’m going to do it anyway,” for there to be deliberate consent? Especially if you are scrupulous?

I do not think that seeing explicit material is sin. It depends on your intentions.For instance, people who categorize movies must see them all to put into age and type categories.

There are so many sights that are against God’s will that you would need to close your eyes in the streets or seeing TV with your eyes and ears closed.

The intentions is what matters. Do you do that with the intention of polluting the love life which was created by God? If not, no problems. Oh! but others are doing and you see or hear: you just saw and heard, you had a passive role and did not had an active role on it. There are mentally sick people who take pleasure on opening their coats and show ladies they are naked. When caught, they are jailed.

But you saw passively. It was even against your will. It was illegal. It put someone in jail. Morally it was absolutely harmless. This was an exaggerated example but to show that it is not what you see but as Jesus said it is the interior that matters not the outside.
 
You aren’t sinning though, how could not sinning be a sin? Unless you specifically changed the channel to a show like that it isn’t a sin. You don’t control which commercials come through. To be honest, you showed great virtue since you knew to turn away, the fact you accidentally heard doesn’t matter. In most cases, it’s the thought that counts, and your thoughts were definitely in the right place. So, don’t worry.
 
Viewing (soft or hard) Pornography is a Mortal Sin.

However, you must know something is a mortal sin, for it to be mortal.

When there are ads on TV that are a near occasion of sin for you, change the channel.
Do not support programs that may lead you to sin.
