There is a case coming before a district court soon, in which the defendant, charged with making a threat, is a man who presents as a woman. The man, I am told by someone working on the case, claims to be pregnant, and says he can feel the baby kicking. The sex of the defendant has nothing to do with the charge, let me be clear, and this defendant is either a nut or a troll. But I wonder: if this trans-female wanted to apply for pregnancy-related disability in a state that had strong transgender protections in its laws, on what grounds would an employer legally refuse? That a man can’t get pregnant? But this is a woman!

This was an amazing article. Thanks for posting. Folks with common sense will get it.

It could refuse on grounds that he/she isn’t pregnant…provable by an hCG lab test. And this would apply even if she was a biological female trying to get pregnancy benefits when not pregnant. It’s not discriminatory to refuse benefits to anyone that doesn’t have the condition they are trying to get benefits for…cancer, diabetes, pregnancy, etc.

This is perfectly logical. I would be surprised if the transgender movement exhibited such logic. On the other hand, if a biological female who identifies as a man actually does get pregnant. could an employer extend pregnancy benefits to a man?

Why not? The benefit is because of the pregnancy. What difference should it make who the carrier is?

I suppose that be giving pregnancy benefits to a trans-man, the employer mirght be rejecting her preferred identity as a man, and treating her as a woman, but who knows?

I don’t I think that has anything to do with it. Pregnancy is pregnancy. It really has nothing to do with the gender orientation of the person carrying the pregnancy.

But since they already discounted one biological reality they can also discount another one.

The fallback here (such scenarios largely gave transgenderism steam) is the threat of themselves or killing themselves, which will try to place blame on people who won’t cooperate in roleplaying their reality with them.

I agree that it’s doubtful, but these sort of cases are inevitable and there are going to be more of them.

People that identify as transgender are suffering and absolutely should not be targeted and bullied and those actions are a blight to society, but when a subjective reality becomes officially recognized to the point that other people should roleplay with them, then other subjective realities are going to start popping up for recognition as well. It’s a completely different example but a guy in the Netherlands recently wanted to have his age changed.
