Hearing Is Over

Today was the last hearing and it went as well as it could.

It started off with the judge saying that the court is ordering that I give my ex-wife $300 to equal have of the money that I got for the kids from the stimulus check. Then the judge said that the court will not order the kids off of my insurance, but that she can see if Medicaid would be willing to come before my insurance. Next thing was me paying the lawyer’s fees. The judge said that she will not order me to pay them as it doesn’t look like I have the income to do so. Then on to the child support.

The judge asked if the income numbers were correct to which the lawyer said yes. I asked if I could ask a question and asked about the credit for the kids up north that I pay insurance for. The judge asked the lawyer her thoughts and the lawyer said I don’t think he should get credit for them. So, I gently reminded the judge that the health insurance up north is court ordered and that my net income is affected by it. The lawyer said something to the effect that she doesn’t believe that I had ever presented that evidence and the judge corrected her and said that I had. The judge ruled in my favor there.

So, I don’t know what the new amount is, but it will not be the $504 she was asking for. She now has to account for the full $700 for the health insurance.

We are considering this a win as it could have been much, much worse.

The lawyer was pissed from what I could see and we’re figuring that she is so because she thought she was going to steamroll me. That she seriously underestimated me and my ability to do research, come up with rebuttals and objections. All I did was tell the truth, and used facts and common sense.
