It was not an appeal, it is still not known if he will be granted leave to appeal, a decision has not yet come down for that.
 
I acknowledge the correction of my learned friend. None-the-less the process of seeking leave to appeal it itself the first stage of any appeal to the high court.

First stage of requesting an appeal hearing. One outcome is it might be sent straight back down to an appeal such as he previously had. Another outcome is no more appeals . Another is they might grant an appeal hearing.
