I heard that a pre-nuptial agreement would be considered as an automatic grounds for an annulment. If it is, does all of the paperwork still need to be filled out?
A prenuptial agreement does not automatically result in an annulment. Prenuptial agreements can cover a wide variety of circumstances and issues. Its only when these circumstances and issues hit the essence of the consent of marriage that they shed light for a possible annulment.
An annulment says that something was lacking from the consent exchanged . A prenuptial could be evidence that an essential element of the marriage consent was missing from the beginning. It could be a valuable piece of evidence but its existence does not automatically invalidate the consent.
