must be different in NZ

in PA at least, its defined as a anyone over the age of 16 with anyone the age of 13 or younger

It would depend on the age of consent. I’m not sure if it’s a federal issue or a provincial issue in Canada (I imagine federal), but I know that the age of consent here is 16. It was recently increased from 14.
