Just War applied to individuals

I just saw the movie Fury, and was wondering if it was OK for them to kill that German who surrendered.

Also, what about the captured prisoner in Saving Private Ryan? In other words, if your little squad is in no shape to have a captured prisoner around, what do you do with him? Especially if he will most likely fight against you if you let him go?
 
:hmmm: You cannot apply the just war doctrine to an individual.

An individual cannot declare war to a nation, and “just war doctrine” regulates confrontation between nations.

If the person is a combatant of your enemy then you are obligated to respect the treaties that regulate what you can and cannot do to prisoners of war.
Breaking the rules of engagement is punishable.
If a combatant surrenders to you and you kill him in cold blood for any reason. You are guilty of murder.

Further, Just War addresses under what conditions a Nation can go to or continue to pursue war.

What you are asking about is the ethical treatment of prisoners of war.

Not just that, but it’s also against the laws of war.

People have been executed for doing what was described above.
