Scenario: a woman that is carrying a baby she does not desire to have, for whatever reason, but usually because the baby has some genetic problem undesireable to the parents. Instead of having an abortion, perhaps because she is too late in her pregnanacy, her OB, through a hospital, induces her before viability, say between 20-22 weeks, and they let the baby die.
Okay, obviously I have a full grasp of the moral issues involved. Clearly that is against church teaching. However, I really want to find the ethical standards, like ACOGS, as well as the legal ones involved. IMO it is rogue euthanasia. I am told that it happens all the time, but that does not make it legal. I am of the opinion that there are no clearly defined ethical standards from ACOG and that it may actually be illegal under state law. Can anyone help me here?
On the ethics side, applicable guidelines would come from ACOG or the AAP. Can’t find any clear instruction despite my search.
On the legal side…We have federal and state law. Federal law, under the born alive act, provides that these babies are afforded rights after born, so the same rules regarding care(feeding/hydration) should apply, and killing the baby would not be allowed, meaning any act in that regard would be murder. First, has anyone seen this enforced? How do enforce it if you think it has been violated? And, what about the induction itself? If an early induction serves only to kill the baby, is that allowed under the state/fed law? I am really thinking NO! Anyone know of any state that, legally, addresses such an issue?
