Marriage between Catholic and divorced non-baptised

This is hypothetical. What is the law of the Church concerning a relationship between a Catholic and a non baptised person who has been married before? Can they marry in church and will the marriage be lawful? :confused:

A Catholic cannot marry anyone until the Church has declared both of them free to marry and until he/she has received any necessary permissions or dispenations for their specific circumstance.

Having been married before, this hypothetical unbaptized person has a prior bond.

Therefore, the prior marriage would have to be examined for validity. The prior marriage might be found null if there are grounds, or it might be found to be valid.

If the marriage is found null, the Catholic is free to marry the unbaptized party provided the Church grants a dispensation from disparity of cult.

If the unbaptized party is found to have been in a valid marriage, then the only recourse would be to the Pauline privilege or Petrine privilege (depending upon whether their spouse was baptized or unbaptized) for a dissolution of the bond. Recourse to either of these are situation specific, so we can go no further with your hypothetical.
