Two Catholics married in a Catholic ceremony. After years of marriage, divorce followed by a decree of nullity.

Husband remarried in an Evangelical church before the decree of nullity was issued. Several years later, he is divorced from the second wife.

Since there was a decree of nullity on the first (Catholic ceremony) marriage, is he now free to marry in the Church again?

He needs to go to confession, but yes, he would be free to marry. Decree of nullity aside, he neglected to follow the appropriate form for marriage in the Church. He’d need to fully disclose the circumstances of his second attempt at marriage to his priest.

He has a lack of form case and needs to meet with his parish priest. There is some paperwork to complete so he can be issued a Declaration of Freedom to Marry.

Unless the second marriage was convalidated after he received his decree of nullity, yes he is free to marry.

Did not receive a convalidation for the second marriage. Was away from the Church at the time but has returned to the sacraments after the second divorce.

He will need to provide marriage certificate, divorce decree etc from second attempt at marriage, simple documentary case.
