Some time ago, our priest dropped out of the priesthood and married outside the Church. He now attends mass but neither he nor his wife partakes of the Eucharist.

What is the Church’s procedure in handling a priest that drops out of the priesthood and marrys? Can he, and how does he get or received Laicization? Once received, is he able to be married in the Church? Is the Laicization from his superior or from the Vatican?
 
I will leave ‘chapter and verse’ to a qualified responder but I want to say that I am edified that the ex-priest is attending Mass but not receiving Holy Communion. It appears he is doing the best he can until his laicization is finalized and for that I admire him.
 
Laicization is granted only by Rome and I believe by the pope himself. He would be able to marry in the Catholic Church. I have missed the mark with a few answers today. I hope someone will correct me if i’m wrong.
 
Had the priest simply “dropped out” of the priesthood, even without seeking laicization, he would be able to receive the Eucharist. His problem is that he entered into an invalid marriage and therefore is living in fornication (or adultery, if his “wife” is a divorcee without an annulment).

(I presume they are living ostensibly as husband and wife. If they are living as brother and sister, it’s a different situation.)
