First of all, the mandatory retirement age is not mandatory at all. It is a suggestion, and that is reflected in the Canons, where it states that the resignation is merely “requested.”
Secondly, the age 75 “qualification” does not apply to the rank of Patriarch or Major-archbishop, only to bishops. I believe a few of the current Patriarchs are over 80.
I accept any correction to anything I’ve stated.

Yes, the retirement age applies to bishops. As heads of Churches sui juris Patriarchs, Catholicoi, and Major Archbishops are exempt from it. And yes, there are a few who are over 80.First of all, the mandatory retirement age is not mandatory at all. As for bishops, as I understand it the law “requests” (read: demands) that a bishop submit his formal resignation, but of course there is no requirement that the resignation be accepted.

«Я не подавав у відставку. Чутки, мабуть, пов’язані з тим, що коли мені минуло 75 років, я звернувся до своїх братів — єпископів нашого Синоду, — і до Папи Римського з пропозицією подбати про майбутнє», — зазначив Гузар.
При тому він визнав, що похилий вік може стати помітною перешкодою для повноцінного управління церквою.
«Я вже не є молодий і не стану ані молодшим, ані сильнішим, ані здоровішим. Треба шукати нові сили, — заявив глава УГКЦ. — Людина старша має бути вшанована, має великий досвід, але вона не має того розмаху, тієї сили, щоби церкву провадити. Це природна річ, і я того свідомий».
При тому на запитання про те, чи підібрано вже наступника на його посаду, кардинал Гузар зазначив: «Шукаємо. Бачте, відтоді як я про цей намір проголосив, пройшло вже два роки. Я тримаюсь тої засади, що ніхто у світі не є незамінний. І що ідеального голови церкви ми не знайдемо».

ЛЬВІВ – Під час прес-конференції Глави УГКЦ, яка відбулась 29 грудня у Львові, прозвучало запитання про те, чи справді Патріарх Любомир збирається покинути пост Глави УГКЦ, як про це заявили нещодавно деякі ЗМІ. У відповіді Патріарх Любомир розповів про своє бачення цього питання. За його словами, передати свій уряд поки він є ще в силах – це раціональне бачення. Це буде добре для продовження справ, однак сам він цього питання не вирішує і такі речі потрібно робити «второпно і спокійно».
«Наша Церква, я не скажу, що вона є в ідеальному стані. Але все таки за ці останні 20 років, від часів переслідування, певні кроки зробила вперед, але ще перед нами довга дорога. В житті Церкви немає такого пункту, що все є досконале. Вона є живим організмом, яка потребує доброго, ефективного проводу. І забезпечити цей провід є дуже важливо», – сказав Патріарх Любомир.
Водночас першоєрарх зазначив, що не може сам цього вирішувати. Для цього є Синод і слово Церкви. «Такі речі треба робити дуже второпно і спокійно, без надмірних емоцій… Я не маю готових дат. Ні. Це є певний процес, головно, щоб було найменше шкоди, а було найбільше користі для Церкви. Щоб життя Церкви продовжувалось і розвивалось якнайкраще», – підсумував Глава УГКЦ.
