It may be his “point” or his view of the matter, but is is at odds with objective reality.
The objective reality of the situation is that there is no other reason why a radical sanation would be necessary between Catholics.

Given the situation, I recommend that the OP apply for the radical sanation. A simple convalidation can cause spiritual conflicts, given the strong objection by one of the parties…I know firsthand.🙂

Dear OnofTheWomen,

I am coming late to the party and I certainly hope you are making progress. I could feel the frustration in your postings as I was in your position almost 5 years ago. Here is what I know as facts from my case which was ultimately decided by The Vatican.
  1. Both parties do not need to be informed or consent. My husband did neither.
  2. We are both cradle Catholics, raised in the Church and fallen away.
  3. We had been married for more than 20 years but neither of us went to church. I stopped when they told me they would not baptize my first-born because I was not married; although I was…just not in the eyes of the church, It was a marriage by common-law (versus civil law).
  4. Because no license was ever issued by state, a convalidation was not an option even if my husband would have agreed.
  5. I was told by the marriage tribunal that the local authorities cannot give a radical sanation when both parties are Catholic but it must go to the Holy See.
  6. It took 2+ years to even find a priest who knew what I was asking for much less knew what to do about it and I live in an Archdiocese of a major metropolitan area. A radical sanation is very rare and patience is truly a virtue in this situation…
  7. Rome took about a year to answer but they sent me a Certificate of the Sacrament of Matrimony on Vatican letterhead and all in Latin. It is beautiful.
  8. My marriage is sacramental and it goes back to the date of our original marriage a couple decades ago.
Always remember…a wife will sanctify her husband. He may be fighting the church now but your prayers and faith will go along way with God and little by little your husband will accept the Graces necessary for conversion of his heart. You may never notice it but God is at work even when we don’t know it. Check out I Corinthians -that is what keeps me going some days.

For personal reasons I did not want to tell my husband at the time but in large part it was because of his bitterness towards anything religious - not for others but for himself. After about a year I told him and he was very pleased for me. He still has nothing to do with organized religion but I will tell you emphatically, the Holy Spirit is working on Him, I believe with all my heart that I Corinthians is right when it says a wife will sanctify her husband. He still is distant from the church but not from God. He’ll get there.

The Catholic Church is perfect and it will eventually come through for you. However, the men that run it are all less than perfect and it sometimes takes them time to get it right even when that is their most heartfelt desire.

Do know that all the time of waiting and working toward sacraments of the Church is graced, even with obstacles you have to overcome, and God works in you even through the difficulties of the process.

That is BEAUTIFUL and TRUE.

The term Radical Sanation means “healing at the root.” The date of Sacrament goes back to the date you were legally married.

Don’t let people pick apart your marriage but remember that neither a convalidation nor a radical sanation will save a bad marriage. My marriage was and is good and healthy but my husband just does not like organized religion, He and God are working that out, I invite him to go to Mass with me every once in awhile and someday he will, maybe.

Jollybird-
I was quite surprised to find this thread again!!
Thank you for sharing your experience, it sounds like we may have a lot in common! 😉
I thought about posting an update, but I never got around to it.

Praise be to God, 2 weeks ago, my prayers were finally answered- 20 years and 28 days after we were married by a JP, our Radical Sanation was granted!! 😃

It has been a long, difficult road, but one I would not change for anything!!

The violation of our rights according to Canon 1115 is one of the reasons why convalidation is off the table. .
It’s the Church! We have no “rights!” 😉

So. You are caught between your stubborn spouse and your intractable Church, sounds like to me. Your marriage has always existed. Your husband sounds a bit illogical to me: if there was no Sacrament - then - it’s not “sacramental.” That doesn’t make it not real or not pleasing to God.

I’m so sorry you are in this position. Ask St Joseph to intercede for you.

He already has! See above 🙂

Hello Julia Mae,

This is off topic and the thread has run its course. But, I must object to this comment. Of course we do have rights. I am not sure what your point is in saying such a thing, or why you would say it, or on what facts you base this comment.

:clapping::clapping: that is great news

Please tell my why and how I am a hypocrite. Also tell me why all the priests I know are not smart.

To the OP, I hope and pray the process is completed soon.

Genesis 2:24 would seem to exclude the authority of others
