Sacramentally invalid marriage. .

Here’s a question from a friend of mine that I don’t know that answer to: If someone is in a sacramentally invalid marriage and that marriage ends, do they still need an annulment? Or is the annulment automatic since the marriage wasn’t valid in the first place? Or do they just need to prove to whatever priest he wants to remarry him that the circumstances of his first marriage create make it sacramentally invalid? I don’t know too much about valid/invalid marriages and stuff so I don’t want to give him the wrong info. Thanks in advance for your answers!

First, the person should speak to their priest about their specific circumstances.

That said, I am a Catholic. I married at a civil ceremony and later divorced. In order to marry my second husband, I only had to prove that:

I had married H#1 outside the church and w/o a dispensation.

I was Catholic at the time of the marriage

We subsequently divorced.

It is called a “Declaration of Nullity Due to Lack of Form”.

It may have to be submitted to the Tribunal as a formality. Depends on the Diocese.
