Not directly, but it is an underlying assumption in the opinion.
On Page 8 of the majority opinion, it says this:
“Only in more recent years have psychiatrists and others recognized that sexual orientation is both a normal expression of human sexuality and immutable.”
If it’s not inherent (inborn) then it’s not really immutable.
But truthfully, I don’t think it would have made any difference. The Democrats plus Kennedy on the Court wanted a result and made it happen. Even if they recognized it as not inborn, they would have ruled the same way.
