WASHINGTON

The Supreme Court said Tuesday it will consider the constitutionality of banning a type of late-term abortion, teeing up a contentious issue for a newly-constituted court already in a state of flux over privacy rights.

The Bush administration has pressed the high court to reinstate the federal law, passed in 2003 but never put in effect because it was struck down by judges in California, Nebraska and New York.

The outcome will likely rest with the two men that President Bush has recently installed on the court. Justices had been split 5-4 in 2000 in striking down a state law, barring what critics call partial birth abortion because it lacked an exception to protect the health of the mother.

Thank goodness! It is time to put an end to this abortion madness. This has been a long time coming. I just thank God that we finally have a Catholic majority on the court. Now, I live in hope that they vote on this issue using their faith as their guide.

Rather, i think they will use precedent as a guide and applicable law. The last ruling they gave stated that “the most blunt remedy” (total overturning) isnt necessary, when the courts can invalidate part of the law, while letting the rest remain. i think they will keep with that mindset.

note that Congress did not include ANY provision whatsoever preventing women from traveling outside the US to obtain a partial birth abortion.
 
This issue will show us if Bush chose correctly, or was he just another wash out.

I can’t see the connection between the decisions made by the USSC and the effectiveness of Bush as president, which is what I assume you are saying.

He put up for consideration people with the highest credentials who are strict constructionists. There really wasn’t anything more he could do considering he had to have the approval of the Senate to see his nominations go through. And we all know the kind of opposition he has had from certain persons determined to undermine him at every turn.

I think what will happen in the case we are discussing what BioCatholic cited. They will overturn a part of the law. Hopefully, the teeth will be left in it so that most of the partial birth abortions that would have been done won’t be. We have to accept whatever gains we can get as we can get them in the current political climate.

Of course, we have recourse to prayer and to the possibility that God will effect some immediate change in our lives that will make it patently obvious to everyone that abortion on demand is the great evil that it is. But until and unless God does that, we have to fight for each victory and work for more, sloughing away day by day, and case by case.
