What is the process regarding a second marriage if the first marriage was not a Catholic one?

My brother in law who was raised Catholic, married a Protestant woman in her non-denominational church. His priest con-celebrated the ceremony, but it was not a Catholic ceremony. Fast forward 12 years, and she divorced him. He has since met a woman, and they recently became engaged. Does he need to seek an annulment even though he technically was not married in the Church?
 
Dear friend,

The fact that the Catholic priest was present for the ceremony, suggests that the man received a dispensation to be married there and that the marriage IS recognized as valid by the Catholic Church. He will need to check with his pastor to see if an annulment is possible.
