Advice needed Son Growing Marijuana

We discovered two pot plants growing in our sons garden, He actively smokes. He rents the house from us. He is in his twenties and away from home for 5 years. He has always had issues from school age on. He is working 3 jobs.
So:
  1. Should we remove the plants?
  2. Evict him?
  3. Ignore it?
We do not want to enable and know he has to hit bottom before looking up. Heavy handed action may break our relationship entirely. Do nothing may result in criminal charges and imprisonment. Any advice accepted.
 
If you want to offer him start-up money to move sonewhere else so he won’t take this as “controlling” behavior, have at it, but don’t rent to anybody you know to do illegal things on your property. What he does in soneone else’s place is their business; this is yours. Do not accept the totally unacceptable, not even once.

I doubt you could be held liable since he is renting. He’s a grown man you shouldn’t try to tell him what to do, he’ll just hate you for it. I’d ignore it. There probably isn’t anything you can say or do that will much influence his actions. Well, short of him getting busted, you going to jail, telling him you knew and did nothing because you didn’t want to alienate him, that is.

He may resent it and be angry, but he has no right to engage in illegal behavior which, worst case scenario, could cause the loss of the parents’ property–but definitely could result in fines and criminal prosecution of the parents (yes, landlords can be penalized for drug-related criminal activity by a tenant). Basically–imagine that this were a renter who is not family. What would you do? Probably 1 and 2, with a dash of “call the police” to help with the removal of the plants.

I disagree. In some states (like mine – unless the laws have changed) they can seize your property if it’s used in certain drug transactions. I would NOT risk it.

What your son is doing is illegal in your property thereby opening you up to criminal and/or civil forfeiture penalties. I would evict him immediately. You’re not doing him any favors by turning a blind eye.

A parent is the only kind of lsndlord that would think twice about evicting. (Considering his track record, most landlords wouldn’t rent to him in the first place)

If you don’t have it in you to evict your own flesh and blood for illegal behavior in your rental, you probably shouldn’t manage your own rentals…
 
Don’t know, but you could also be opening yourself up to criminal charges yourself (aiding and abetting-type charges) if you know it’s happening and continue to let him rent from you.
 
Since you know about it, if you let it continue you could be liable. Now that you have posted it online the police can show proof that you know about it. If he is growing it there, he is probably dealing it there too. Going to jail could be the least of your son’s worries if he is dealing. It’s time to call the police and have him evicted. It could very well save his life.

Sometimes tough love is necessary.

They ought not destroy nor take possession of his illegal property. They cannot prudently have the least thing to do with them. They probably have no legal authority to seize them. At most, they can require him to make and keep the property free of such items. (It would be wise for then to consult local property law about what their duties are, and do that at the very least.)

No, their tenant is the one who has to get rid of anything he owns but that the landlord does not allow. The only exception are those things the landlord has removed with advance written notice, and in this case they’d have to notify police to do the removal. If they want to avoid heavyhandedness, that is a last resort option.

You said that if you evict him it may end your relationship entirely. Don’t do something that you may come to regret, even if there is justification for evicting him. Severing family relationships produces ongoing suffering.

I would suggest talking to him, telling him that he absolutely cannot have or use drugs on your property, and include the liability risks his behavior is making you vulnerable to. Be firm about it. Tell him that if you see plants or drugs around the house, you will be removing them. If he wishes to move somewhere else he is free, but if he stays in your house, you insist he comply. And then follow through.

Oh good grief. This is the problem with our tyrannical nanny state government. Go to Lowe’s, get a metal 6 gallon pail, lighter fluid, matches, and a greensheet free newspaper on your way out. That’s $10-20. Go to house. Put paper in can. Add weed. Squirt on some lighter fluid. Throw a match in. Done. No need to hire 3 lawyers and consult with 17 government agencies. Tell him not to grow anymore pot.
 
Can you just tell him that you do not allow marijuana on your property and ask him to remove the plants?
 
Any threat by your son of severing his relationship with you and your wife is nonsense! He is just bullying you to get his own way and continue to sponge off of you. For all intents and purposes, he should have been on his own at the age of 18, give or take a couple of years.
If he were my son (and I have two, both in their 40’s), I would tell him to get those plants off of my property immediately, or I am calling the police. If he reacts negatively tell him he has 24 hours to leave or the police are definitely going to be called. If he “calls your bluff” then do call the police.
You may temporarily sever relations with him, but sooner or later he will come back to you - especially when he wants something from you.
 
Evict him. He is taking advantage of you and putting you in danger of breaking the law as well. It’s your property. DO NOT ignore it. 😉

White Sheep - I see your point put I think he would continue to grow it. Even if the parents continued to destroy it multiple times the son would still find a way to grow it. I say evict him so at least he won’t be doing it on their property. An eviction is also a good way to make him grow up and realize what he is doing is WRONG.
 
Great response all. Thank You. It is difficult for sure. We went to remove plants this afternoon and they were gone. We went with Caroline723 approach. He remains but under strict watch with zero tolerance going forward. Now for all those read this and / or are reading this I would ask for your prayers, especially for intercession of our Blessed Mother, and St. Michel the Archangel in fighting this battle. Again thanks for your assistance.

That doesn’t sound great for your peace of mind or your relationship, either.

Figure out how to get him out of the house as quickly as possible (perhaps consult a lawyer). Do it with a smile and a pat on the back, but get him out as quickly as you can. Maybe set him up with a deposit for his next place, as compensation for breaking his lease? I think tht’s not unreasonable.
