I have a relative that married at the courthouse. They were both fallen away Catholics. They divorced. One member is now coming back to church. Is this a valid marriage that needs an annulment? Or are courthouse marriages not considered valid?

It’s likely a lack of form case, but they should speak with their priest and go over the particulars to find out what they need to do to proceed. If they are just looking to come back to the Church and haven’t remarried, the annulment is not needed in order to receive the Eucharist. They would just need to go to confession.

An annulment is still required if the family member who is coming back ( God Bless them ) ever wants to remarry.
