Are atheist, agnostics and apostates the same? OK, I know there not by definitions; but are they the same by choice?

Not sure what you mean by “the same by choice”.

If you mean, “If a person chooses to be an atheist, did he choose to be agnostic?”.
No. If he chooses to be an atheist, then he is not agnostic at all.

If you mean, “If a person chooses to be an atheist, did he choose to be apostate?”
Depends. Was he a member of a religious group? If so, then yes.
If not, then no.
 
The three powers of the soul are intellect, will, and passions. As God is one and the source of all that is and that all creation points to Him, truth is knowable without His Grace.

It is our nature as created by Him to desire to reach our perfection and we cannot reach this perfection without Him and His Grace. When we fail to reach this perfection on our own and we decide by our will to be content without His perfecting Grace or are content to lose it by an apostasy, it is the same act of the will in all instances.

The individual culpability related to knowledge (we cannot love what we don’t know), or passions (levels of desire leading the will and thus the will not being moved by reason) may be reduced or mitigated altogether. It is our primary mission to save our souls by union with the Father and related to this are the acts related to our neighbor. In the end though, it is their choice by an act of the will to ignore the God of Creation, Love, and Grace.

It occours to me that each in “there own way” Deny God… does why really matter?

An agnostic doesn’t deny God. An agnostic is unsure if God exists.

An Apostate need not deny God either. A Catholic may become an apostate by becoming Jewish.
