If the divorce occurred because of particular mortal sins the person committed (e.g., abandonment, abuse, addiction, adultery) or if the divorce occurred without just cause (e.g., the spouses simply “gave up” on their marriage), the person would first need to go to confession and be restored to a state of grace. So long as he remained in a state of grace and so long as he did not attempt remarriage without an annulment from the Church, he is free to receive Communion.
