I have been in discussion with a catholic friend of mine who also happens to be a constitutional law professor. and we have had discussions regarding the HHS mandate. he and I both agree that the original proposal by the HHS does not stand constitutionally. we agree on this on the grounds that having a church pay for this mandate violates the establishment clause.
Regrettably, he and I disagree on the “compromise” offered by the administration. he argues that since all insurance companies provide contraceptive coverage according to his estimation there is no first amendment issue at stake. I have raised the issue that the church is still passed the cost and it restricts the existence of insurance companies that follow catholic teachings from existing and that in of itself can be an establishment clause issue. He asked me if I could name any companies that do such. I argued that names do not matter if the principle still stands, he does not accept that, and will only accept existing companies that are at risk constitutionally as proof for my point. I’ve decided to humor him because I know such companies exist but I need help finding them.
So far I have found fideliscare in NY but because NY is a state which guarantees contraceptive coverage under medicare and a loophole exists to such an effect. I feel using this example alone will be a weaker argument than I intend to use.
can anyone help me by providing a listing of insurance providers in the united states which conform to the church’s teachings on contraceptives/abortions?
