So tell me folks----does this charity just need to buck up and pay it’s “fair share”?

Or are people going to finally start understanding that this is what high taxes do?

But if they do go under, guess it’s good they’ve got all those liberal & establishment elites in DC and northern Virginia who “care” so much about them, why, one would think they’d be more than happy to take them in with their average salary of 110K a year and 3% unemployment…

Well from the article, it appears the charity states that it runs a “residential and life skills centre” and the tax regulations require a “homeless hostel” for it to be tax exempt. Sounds to me that the charity meets the requirements but could have made what they do clearer. Nevertheless, HMRC’s decision here is arguably wrong.

See for instance the decision of the First Tier Tax Tribunal in Atlas Property London Ltd v Revenue and Customs Commissioners

“The provision by the appellant company of accommodation for the temporary homeless amounted to an exempt supply of interests in land.”

The legislation in question provides that an exemption from VAT is provided for “the provision in an hotel, inn, boarding house or similar establishment of sleeping accommodation or of accommodation in rooms which are provided in conjunction with sleeping accommodation or for the purpose of a supply of catering”. “Similar establishment” includes premises in which there is provided furnished sleeping accommodation, whether with or without the provision of board or facilities for the preparation of food, which are used by or held out as being suitable for use by visitors or travellers. Value Added Tax Act 1994 Part II sched 9 group 1 item 1(d) and note 9.

I’d strongly suggest that the charity seek legal advice on an appeal to the tribunal. £1 million is a lot to loose because an official didn’t interpret the regulations correctly.
 
Well … it’s England. There’s a state church … and Catholic isn’t it.

Today there’s just taxing. Back in the Tudor’s day they took the whole Church, grounds, universities … and some of the priests (and Bishops’) lives.

TAXES show that a country REALLY cares about the poor. :pshaw: Everybody knows that.

🤓 - People can be just as poor and homeless without denying millions to their government.
