I have been puzzled by the changes in the laws of the U. S. in the past few decades.

Has anyone compiled a list of major changes in the law such as no fault divorce, legalized numbers game and other major forms of gaming, marriage laws and so forth.

I would love to see how the laws in the U. S. have changed in these major areas.

HELP!!!

Most of the major changes in our laws over the past 50 years have come not from legislative bodies, but from our courts.

Gay marriage is legal thanks to a court.
Prayer in school is over thanks to a court.
Abortion is legal thanks to a court.

The power of the courts to throw out a law for being unConstitutional is called “Judicial Review”.

The great irony is that the act of “Judicial Review” is not a power given to the court by our Constitution. It is therefore an unConstitutional power.

Judicial Review was created in the early 1800s by the Marshal Court in the case Marbury vs Madison. Marshal warned that it was extra Constitutional move and cautioned that it should only be done sparingly.

Fast forward to today: Judicial Review seems to be the ONLY thing courts do anymore. The people spend all the time, money and energy to push through laws they want only to have it thrown out in 30 seconds by a sitting judge. It’s outrageous.

And the Judge can rule any way he wants too for any reason he wants too.

Take California’s Marriage Amendment (the law defining marriage as between a man and a woman): the judge threw the law out. In his decision, he cited very little law himself. Instead it was a big list of grievances the gay community has against American society. The Judge went on to declare his decision “with prejudice” - meaning the Prop Marriage side could not appeal the decision.

Now - the judge in this particular case is openly homosexual himself and has been living with boyfriend for many years.

It’s completely absurd what our courts can do.

I knew about Marbury vs Madison. I did not know that he said it was unconstitutional.

THANKS!!!

Well, thanks to the Great Society programs we now live in a society where the poor are traped by a system that effectively turns them into vote catlle, turning out every cycle in hopes of expanded benefits.

The congressional power to declare war has also been esentialy cut out, continuing and expanding out interventionist forgien policy directly warned against by the founders.

Our governments size has increased insainly and now has the power to search or detain persons without warrant or trial and can look into your private life without you even knowing.

And various substances ranging from blatantly dangerous to extreamly usefull for medical treatment have all been made illegal, and their users and producers are subject to brutal police actions and massive jail time in the name of a “war on drugs” which has lead to a surge of organized crime based around providing these formerly legal substances, and these groups now control most of the territory across our souther border.

In short, government is bigger, more intrusive, and treats us as tax cattle.

Thankfully! I don’t want my kid being forced to take part in some Protestant prayer service that could run contrary to Catholic doctrine. I don’t understand how any Catholic could see the cessation of forcible religious participation as a bad thing.

Edit: I see that you aren’t Catholic. I apologize. But you are not bound to have many supporters on this forum on this specific issue, especially since “Christian prayer” in public schools has meant “we don’t want Catholics anywhere near this” in American history. Obviously, orthodox Catholics will support your position on gay “marriage” and abortion.
The Judge went on to declare his decision “with prejudice” - meaning the Prop Marriage side could not appeal the decision.
Not true. They couldn’t appeal, because they weren’t the defendants in the case. The USSC actually ruled on that, not the judge.

While I, too, am upset over some of the changes that have occurred in the last 50 years (many before I was born), there is no reason to use falsehoods in your argument. They weaken, not strengthen, your argument.

The biggest: Roe v Wade, 1973. Millions of unborn children legally slaughtered and abortion is now a right, and pregnancy is now a disease.

Does any one know and can explain the Marbury vs Madison case?

Also, does this case open the possibility that the Supreme Court members as not in good standing? Or whatever the legal terms would be.

This case dealt primarily with the SC’ s Original Jurisdiction power and it struck down that part that sought relief. It was also a basic clarification of;

Article 3;

Section 2.

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;

What is a CASE? Of course it is a complaint brought before a Court. If the Court’s had no power of Judicial review, why is there a provision in the Constitution creating the SC and inferior courts?

If you mean exceeding their Constitutional authority, if they say NO, it is no.

There is nothing in the Constitution about the SC holding a criminal trial, yet they decided they had authority to do so, and did, ONCE.

They have also overturned themselves about 200 times since their 1789 inception.

Most laws have been changed at the state level. It is generally easier to get a law changed in one state first, then use that to convince other states to pass similar laws.

Lotteries were generally passed as a way to provide additional money to schools. These were passed on a state basis. Indian casinos were done the same, as were divorce laws.

Some laws are passed because states want money from the government. Speed limits and the drinking age are good examples of that.

States have their own constitutions These constitutions must support the U.S. constitution, but they can give additional rights. State judicial systems are usually responsible for determining if a state law violates the state constitution. The U.S. Supreme court is responsible for making sure state and federal laws don’t violate the U.S. Constitution.

Rights of individuals have grown. Or at least their right to enjoy their rights.

Glass-Steagal was dismantled.

Concealed weapons.

Pure water act.

Endangered species act

Numerous laws for the protection of the environment.

Some changes are good some are not.

All very true, and whats truly frightening, even though our Constitution REQUIRES the american public to actually do something about this type of govt should it happen, but in our world today, no one is doing anything to stop it…? Plus, even if someone were to attempt to put a stop to it and do their constitutional duty, most people and virtually all law enforcement, judges, media, etc would see that person as a domestic terrorist.

I can understand the media, law enforcement, judges, govt deeming this type of person a domestic terrorist, after all the person is trying to put a stop to something they have all become accustomed to, BUT for a large population of other people would also see this person as a domestic terrorist…This makes little sense to me, they are attempting to save the country, but I guess most of the population is too far gone (brainwashed) by media and Govt, so even if they do see someone trying to fight for the constitution, they would just see them as another dangerous terrorist who needs to be put in jail…LOL WHAT IN THE WORLD HAS BECOME OF THE US? LOL

Look at how alot of people think of Edward Snowden…all he did was try to show the public some of the wrongs our Govt is doing, and what does he get…alot of ‘fellow americans’ would turn him over to the police in a heartbeat!! just because the media and govt did not agree with what he did…well DUH, of course they arent going to agree, he is shining the light on them…too bad so many ‘americans’ are too stupid to recognize what he was doing, they are more interested in protecting our corrupt govt! lol Funny thing though, if this had happened around the time of the nations founding, those kinds of people would NOT have been popular and probably wouldve ended up in a ditch somewhere for being so un-american.

even stranger, we celebrate all that the founding fathers did, have speakers talking about how great their actions were, how patriotic they were, how great america is, etc. BUT if those same founders were alive today and did the same thing, they would be arrested quickly and be called terrorists…?? Im not sure why people are celebrating 4th of July, when they would knowingly turn someone into police for some of the exact same things done by our founders? I dont understand this country anymore.

Please forgive my naive spirit.

On many levels, the private citizen can do little at the national level.

Jesus did nothing at the national and international level.

He loved, and that is all we have.

There are two kingdoms, and we just do not belong to one of them.
