Well that’s just two ways of saying the same thing. I’m saying that, in the eyes of the church, a marriage by two people by a justice of the peace is just as valid as a marriage of two men by a justice of the peace. So what difference does it make what the state does? They don’t recognize the civil marriage of a Catholic who didn’t obtain a dispensation from canonical form. They recognize the civil marriage of most others as long as there is no impediment to the marriage.
