Confused. Stealing?

This question is probably very dumb, and the answer is probably obvious, but I don’t know for sure.

I cracked the screen of my phone, fortunately I was able to get a replacement of the same phone for a discount price. However, when this phone came in its box, there were instructions on returning my other one (I knew about this). Also in the box, though, was a new battery, a new SIM card, earphones, a charger, instructions on what to do next, and some other things.

Well, the return-instructions say to take the battery and SIM card out of your old phone and put it into your new phone. I instead placed the newer battery that came in the box into my phone along with my older SIM card. I left the new SIM card in there and am going to place my older model of the phone in there (along with the battery). However, I am unsure if I am stealing… I’m afraid to use the earphones and other accessories that came with it (although I have opened and used those earphones… but if I find out I am stealing I’ll put them back. That’s okay, right? I don’t think I am in the wrong right now…).

The instructions don’t say really anything about the included accessories, and I thought it would be okay to use the newer battery since it was shipped to me (along with everything else).

Am I in the wrong? Everything WAS shipped to me, but I fail to be able to see if I am stealing or not. Why would they ship me things I can’t use? 🤷

And if I am in the wrong, I haven’t shipped the box back yet, so I wouldn’t have to provide further restitution than to put back the accessories and replace the batteries, right?

It depends on the company you’re involved with. My understanding, although I’m not 100% sure on this, is that the insurance company that Verizon uses (just for example), ONLY requires the PHONE ITSELF to be returned.

In other words, when you get an insurance replacement phone, you can technically KEEP your old battery, memory, and SIM card, as well as the new ones that they mail to you. All you have to mail back is the phone itself (with the battery cover, if available).

If I were in your circumstances, I would double check that. Just ask your phone company for a copy of the terms and conditions involving your insurance coverage on the phone.
