Could passing a bill that makes abortion illegal in a state make it more difficult to make it abortion illegal in the Country

simple question

but my home state of Louisiana is passing a bill, HB 645, which will make abortion illegal in all cases except life of mother.

The issues I have with this is I don’t think this is going to do much of anything if passed and signed. Because the USSC will overturn it more then likely, meaning that it will become more difficult to overturn RVW in the future. The more USSC decisions that go for RVW make it more difficult to overturn that ruling in the future.

So I ask is passing this law a good thing or a bad thing?

Oh wow. I’m from Louisiana, and I never really looked at the actual content of this legislation. I probably should have, though.

From what I read in the digest, it follows almost exactly the pro-life point of view, and I think that’s a good thing. So even though it might get overturned, it still puts this point of view out there.

If SCOTUS overturns the law, then yes it will be more difficult to enact similar legislation in the future. However, it is much more likely that the US district court will overturn the law, and SCOTUS will decline to hear the appeal. If the Supreme Court actually does choose to hear the case, there is a decent chance the law could be upheld, and legal precedents reversed. I don’t think this is very likely, but I don’t see much danger in the Louisiana legislative action. Note that I haven’t actually read the bill, this is all off the top of my head from what you’ve written.

Also, if the court rejects a pro-life law,they often cite a specific defect. The next time a state passes a similar law, that defect can be directly addressed. This is what happened with the parental notification laws and with partial birth abortion.

I am not as familiar with the Louisiana law but at least one state has passed (or at least considered) a law that has a “trigger”. It only goes into effect when RvW is overturned. After all, overturning RvW only turns the abortion issue over to the states, it doesn’t outlaw abortion.

Louisiana has a trigger law. Abortion will be illegal in my state if RVW is overturned.
