exactly Joe - but frankly I can’t see any charges sticking. Maybe she was addicted and couldn’'t help but get her fix, sad but true. Unless she was purposefully trying to kill her baby which would have been viable is born, I can’t see this being homicide.

You’re confusing the legal term of Homicide with murder.
Homicide is the killing of a human being by another human being but Murder is killing of a human being with malicious intent. Which means she could be accused of manslaughter which is accidental homicide or unintentional.

I think the real point of the charge is that by declaring her crime a homicide, they are infact saying her fetus was fully human and ergo protected by law unlike aborted fetuses which aren’t considered homicides because they aren’t considered human. In order to declare homicide, the victim must be recognized as human.
