Did he sin?

When he killed his wife “in his sleep” due a “sleep disorder” did he sin? Were he Catholic, would he have to go to confession?

To commit a mortal sin three conditions must be met.
  1. The object must be of grave matter
  2. It must be committed with full knowledge
    3)It must be commited with deliberate consent of the will
In the case you brought up, only the first condition is met so no this is not a mortal sin. It can still be a venial sin but we must only confess mortal sins. We can confess venial sins but that is not “required”.
 
If he really wasn’t aware of what he was doing, then no.

If he did it in his sleep though was he totally unaware? Was it like a dream? Why would he kill his wife, even in his dream?

You have to prosecute this guy. Otherwise people will be running around killing each other and claiming to be asleep. He is clearly a danger to society.
 
Well wether its a sin or not- thats up to God, but I dont believe it, not for a second.

Lets say he had been dreaming. And he got her in a choke hold. I’m sure at some point, before he started actually CHOKING her she woke up- but lets say she didnt, lets say SHE slept thru it while he got her into position-

When he started CHOKING her- she would have woken up. She wouldnt be able to breathe, and would have woken up KICKING and SCREAMING. Lets say that she couldnt scream because he gave her a really good choking- she would have been CLAWING AT HIS ARMS with her nails, reaching for the bed post- fighting for life.

He was coming off of anti depressent pills. He wasnt ON sleep medications. He would have woken up due to her flailing on him…

did they LOOK at his arms/back etc? I have a hard time believing he got out without a scratch- that is unless she didnt put up much of a fight, because the circumstances were different…

IMO- this is ridiculous…but I’m not God, I cant personally judge him- and killers get off the hook all the time so- i guess its whatever.

totally ditto…i feel they didnt look into this enough…they made it too easy…

To prosecute someone for a serious crime which they committed unintentionally is a violation of that person’s human rights. Let’s not make assumptions about this case–there are a number of cases every year where someone kills another in his or her sleep or under an insane delusion in which the person had no idea at all what he or she was doing. Surely if you killed your spouse in your sleep you wouldn’t want to be treated this way. And its not much use saying “I would never chose to do that” because this person argues that he did not chose to do it. Of course, if he is lying, that is another story, but let the jury make that determination…
 
Anyone who is capable of killing in his sleep is a danger to society and must be dealt with. If this truly happened the way he claims, then he doesn’t belong in jail, but neither should he be allowed to go on as though nothing happened. He killed somebody! Wonder what the mother of the victim thinks?

I’m just saying that if you kill people in your sleep, you’re dangerous. Whether or not you intend to do it, or wake up and realize what you did and feel horrible. You need to be somwhere where you can’t hurt anyone. Maybe locked in a room while you sleep, or something.

If I killed someone without my knowledge in my sleep. I would volunteer to have myself locked in a room while I slept.

This also happened in my home country of Scotland one time.
Frankly I do not believe these people and I consider they got away with murder
