THEY ARE BEING SUED BY A FORMER MEMBER OF THEIR MONASTERY. Apparently he donated over 1 million dollars to the monastery when he joined. He wants the money back now.

Racketeering Charges Entered against Holy Family Monastery
U.S. District Judge Allows Case to Proceed against Dimond Brothers

The Daily Record of Rochester, New York, has reported that a U.S. federal lawsuit has been entered against Holy Family Monastery in Fillmore, New York, for fraud by a young man who turned over almost 1,400,000 U.S. dollars in cash and stocks to the monastery. Eric Hoyle joined the Most Holy Family Monastery to become a Benedictine monk under the guidance of Frederick Dimond. Hoyle claims that Dimond, known as Brother Michael, who operates the monastery with his brother, Robert Dimond, told him that he would have to turn over all his worldly possessions to the monastery. He did.

The Daily Record reported that after joining the group in September 2005, Hoyle transferred securities valued at 1,200,000 U.S. dollars and gave thousands to the monastery, according to his federal complaint. He also signed an agreement that he would receive $750,000 if he left. Hoyle did leave on December 31, 2007, and filed a federal lawsuit against the Dimond brothers to recover his donations. The amended civil complaint accuses the Dimonds of fraud, negligent misrepresentation, unjust enrichment, plus racketeering and several additional causes of action.

The Daily Record reports that the lawsuit will go forward in federal court, as the defendant Dimond brothers’ attempt to dismiss the case was recently denied by U.S. District Judge John Curtin in Buffalo, New York, who also allowed plaintiff Hoyle to add several causes of action to his complaint, including a conspiracy claim under the federal Racketeer Influenced and Corrupt Organizations Act (RICO). The judge upheld the racketeering claim, saying that plaintiff Hoyle alleged specific facts which, if true, would show that the defendants conspired to commit a crime by making false representations and by soliciting donations and postulants for several years. The judge also said that plaintiff Hoyle was entitled to pursue claims for unjust enrichment.
 
It seems that the Dimonds could be charged criminally—wouldnt that be something
 
It seems crazy to me that someone could give these two “Brothers” 1 million dollars and there is no over site at all. Smells fishy to me.

Here is the situation, as the law sees it. If you hold money as tax exempt it is a place of funneling money or (laundering), they cannot HOLD the money, which means give it back. Also, have you ever asked for your donation back from the church offering plate? Another thing is, the Brothers may have already spent the money informing the public or whatever they do. Imagine someone who wanted to cross them up. They would just have to make them go into debt by falsely joining and taking back the money, wouldnt they. The Brothers are right in this, the donor was a grown man who made a grown man decision, and to boot, can you change your mind after you join the Army?

It seems this guy joined the monastery, thinking it was affiliated with the Catholic Church and the Confœderatio Benedictina Ordo Sancti Benedicti, commonly referred to as the Order of Saint Benedict and which commonly uses the initials of OSB. This confustion was, in part, because the Dimond brothers use the initials OSB after their names. However, the monastery is not connected to the Catholic Church or any of its religious orders.

When the plaintiff found out that they weren’t so affiliated, and that he couldn’t actually be recognized by the Catholic Church as a Benedictine monk, he left the monastery and filed suit. The central point will be what constitutes a Benedictine monastery, and whether the initials OSB belong exclusively to monks and monasteries affiliated with the Confœderatio Benedictina Ordo Sancti Benedicti.

I think you may be right here. I don’t think TV Evangelists ever had to give money back when they failed to heal as they promised. It doesn’t mean they can’t get tried on criminal charges though, especially if fraud or some sort of ponzi scheme can be proven.

If found guilty, they should be ordered by the judge to go to Confession; with a Novus Ordo priest as the Confessor.
An ex-Feeneyite priest would be a good choice.

To bring about Catholic news is one thing but the gossip sure runs deep on this site.
 
The court has recently denied the Dimonds countersuit as well as denied Eric Hoyle’s counterclaim.

The Dimonds won’t be getting anymore money unless they are able to convince Mr. Hoyle to hand it over voluntarily. 😉

The Dimonds give true Catholics a bad name. 🙂
