I guess they will not be able to use this case for banning the death penalty:
DNA Tests Show Executed Man Was Guilty

**RICHMOND, Va. – **New DNA tests confirmed the guilt of a man who went to his death in Virginia’s electric chair in 1992 proclaiming his innocence, Gov. Mark R. Warner said Thursday.

The case had been closely watched by both sides in the death penalty debate because no executed convict in the United States has ever been exonerated by scientific testing.
For the record, I am in favor of the Death Penalty, but only in extreme cases. I have not seen one in recent time where it is warranted using the guidelines in the Catechism of the Catholic Church.
