"The Indiana Court of Appeals has tossed out two feticide convictions in the case of an Indianapolis man who shot a pregnant bank teller during a 2008 robbery.

In an opinion issued today, the court of appeals said Brian Kendrick shouldn’t have been convicted of both feticide and attempted murder. The same evidence was used to prove both of those charges, which conflicts with Indiana’s double jeopardy law, the judges said."

I don’t understand how this could be a form of double jeopardy! By shooting this woman, he killed the twins she was carrying (feticide) and attempted to kill the mother.
 
That’s disingenuous of the court. There is one critical piece of evidence that was different for each of the 3 charges: the identity of the victim.

EDIT: Since the lower court will now re-sentence, hopefully that judge will be sane and increase the attempted murder sentence to the statutory limit while the D.A. appeals.
