Although the requirmenets for EMHCs are set by the bishop of the diocese, and this specific item may not be addressed in a written form, in general a person in an invalid marriage would not be able to perform such a function. I recall reading someplace that even if they are living as brother and sister they may be restricted from receiving communion at churches where they are known; again to avoid giving scandal.
