Florida court rules the 13 year old has the "right" to abort

WEST PALM BEACH, Fla. - A judge has ruled that a 13-year-old girl at the center of an abortion fight with the state may terminate her pregnancy, and Gov. Jeb Bush said Tuesday that the state will not appeal further.

Juvenile Judge Ronald Alvarez ruled Monday that the teen, who has been in state custody for four years, would not be physically or emotionally harmed by the procedure. Last week, Alvarez blocked the girl’s abortion until a psychological evaluation was completed.

“He ruled that she is competent, that she has made a decision and that she has a right to act on that decision,” said Howard Simon, executive director of the Florida American Civil Liberties Union, which represented the girl.

It was unclear Tuesday whether the girl, 14 weeks pregnant and known only as L.G. in court papers, had yet undergone an abortion. Calls to the girl’s attorneys seeking an update were not immediately returned.

State Department of Children & Families spokeswoman Marilyn Munoz said the agency would “respectfully comply with the court’s decision.” She declined to provide further details.

“We are working for the best interest of the young girl,” Munoz said.

The teen became pregnant after running away from the DCF shelter where she lives.

“It’s a tragedy that a 13-year-old girl would be in a vulnerable position where she could be made pregnant and it’s a tragedy that her baby will be lost,” Bush said in Tallahassee.

The department had argued that the girl was too young and immature to decide for herself to have an abortion. The agency said state law prohibited the agency from consenting to the procedure.

The girl told the judge last week as part of the psychological evaluation process that she wanted an abortion, citing her age and no way to support a baby. The girl’s ACLU attorneys argued that Florida law protects a minor’s right to choose an abortion.

A measure is moving through the state Legislature to require notification of parents or guardians when girls seek abortion. In 2003, the Florida Supreme Court struck down a 1999 law requiring parents to be notified if their minor daughters seek an abortion.
 
Yeah right, a 13 year old has a well formed conscious and can make such a decision. Let’s see, we’ve got a kid who’s involved with human services, she ran away and got pregnant. Sounds like a good rational decision maker to me!

Whether she could support the child is not an issue. But the ACLU is there to ‘protect’ her, not the baby. Typical but incredibly sad.

Hmph. Bull “caca.” I would imagine it would be slightly uncomfortable to have instruments jammed into my reproductive organs.
 
Not surprising that they didn’t even mention the rights of the baby. This girl could give birth to that innocent baby and then have him/her adopted to a loving family. What a shame.

Sorry Jeb. Her baby won’t be lost. He/she will be killed.

Yet another reason why we need to end judicial tyranny.

Ha! I couldn’t even get my ears pierced without parental consent! Yet, a 13 year old, who obviously is acting out and making very poor decisions(I won’t say getting pregnant was one of them because she could have been raped) has the maturity to decide to have a major medical procedure that has a high potential of doing major physical damage to her body?

Our Lady of Guadelupe, patroness of the Americas and the unborn, we ask your intercession for this mother and this child. Amen.

This is not going to be a dilate and vacuum procedure - the baby is going to have to be dismembered.
This is when there is also an increased risk of internal organs of the mother being punctured. Risk of hemmorage and infection is also increased.

Is anyone investigating the obvious CRIME of statutory rape that has been committed?

Boy oh boy -what is up with Florida lately?

Jeb Bush is Catholic, he should be denied communion. This is no different than John Kerry saying, “Well I’m Catholic but I wouldn’t want to impose my views on anybody else”

Wishing death on someone probably isn’t the solution to the culture of death.
 
This same girl would need a signed permission slip to go on a school field trip though.:confused: What an abysmal decision 😦
