Last night, Fox Network broadcast a special hosted by Britt Hume titled “Religion in America.” It was a very worthwhile program, tracing the historical and legal developments concerning the effect of American constitutional law with respect to the role of religion in American public life. On the whole it was quite supportive of and sympathetic to the proponents of a place for religion in our public life.

Of interest was the detailed look at the 1947 decision of the U.S. Supreme Court in the Everson case. In this decision, Justice Hugo Black, a notorious anti-Catholic bigot and former KKK member, emphasized the so-called “separation of church and state” language from a Thomas Jefferson letter written in 1802. It is this decision and its rationale that gave rise to the increasingly anti-religion jurisprudence of the last @ 60 years. The Fox program strongly implied that Black’s fervent anti-Catholicism motivated his opinion in Everson.

On a positive note, the program noted how recent litigation has focused more on the free speech rights of religious adherents when confronting governmental efforts to obstruct or prevent private expressions of religious faith in public places.

Anyway, I don’t know if it will be re-shown but if it is it will be worth an hour of your time to watch it.
