IIRC this is based on Deut. 25… so is this another case of “competing” scripture quotes?

Sort of. That’s the “levirate” admonition, on which Scarisbrick, HENRY VIII, talks a good deal (pp.163-180). It certainly weakened Henry’s causa, as he presented it.
