Just looked up the canon. Among other things, c.1323 says:Someone who gets an abortion deliberately and knowing it’s wrong but is not aware that it is an excommunicable crime has committed mortal sin but I don’t think they necessarily are excommunicated latae sententiae
So, although negligence comes into play, you’re right that ignorance prevents imposition of a penalty (such as excommunication).Can. 1323 The following are not subject to a penalty when they have violated a law or precept:
2/ a person who without negligence was ignorant that he or she violated a law or precept; inadvertence and error are equivalent to ignorance;
