I need advice from a Catholic perspective

Assuming that all the paperwork is proper and that the home is entirely in your name, then you have the right to get them out of the house simply by giving them 30 days’ written notice – assuming there’s no lease agreement in place, it would be considered a month-to-month lease. The same would hold true of your friend “M,” just would need to give 30 days’ notice to vacate the house.

You definitely need to ensure that all was done properly to put the house in your name. I would urge you to contact a lawyer. If your mom is in debt and is moving around assets to keep from paying those debts, that could open you up to some legal ramifications – again, I’m not a lawyer; but you need to protect yourself!!!

However, there are some moral issues at play I will comment on.

  2. You shouldn’t throw your mom out. You don’t have to agree or support her bad choices, but you didn’t pay fair market value, or anything close for the house. Even if you did, do you really want to throw your mother out of her own home?
  3. If you can afford it, consider moving out, perhaps you and your friend can be roomates and share the expenses. Tell your mom how you fell.

It is not illegal to sell a house for $10. I don’t remember the specifics of it from law school but this is somewhat common among families. It’s called something like nominal consideration or something. I don’t do any real estate work so I don’t know the in’s and out’s but yes, it’s legal.

Yes! but like jrabs asked you, is the Title in your name? are the taxes in your name? Do you pay the taxes? Turning the Title over has to be notarized, either by an attorney or a notary. In my state it has to be notarized by an attorney because a new title has to be made with the notice of transfer and each persons name on it, The one who is selling the house and the one who is buying it, I realize you can sell a home for whatever you want, so what I was asking (although I put it poorly) was, if all the legal requirements had beeen fullfilled.

I was trying to see if I were in your situation what would I do.

I think first thing is get a different job, like others had mentioned.

Then talk to my mom, and told her that you don’t like L and you think this much of him. Told her you only welcome her to stay here, but not L. And if she still prefer L over you, then tell her that legally this house belong to you, but you don’t want to take advantage of the situation so you’d like to sell the house and split the money.

If that doesn’t work the pursue the legal route, otherwise just leave. Pray a lot also.

I think there is a commandment you might want to consider. Honor thy father and mother. L is not your father so I wouldn’t plug him into the equation, however, your mother seems to have trouble making good choices in her life. It sounds like she is in money trouble and was afraid of losing the roof over her head because of liens that might be attached to the house? Did she pay for this house? I take it she pays your wages as well?

Was the house paid for by someone else who intended the house to be yours one day?
Have you been paying all the taxes and paying for all the upkeep of the home?
Do you have any other entitlement to the house other than your mother put in your name to keep from losing it some day?

If I were in your situation, I would make sure that the paper work is all right and tight. If the paperwork is unshakeable, I would make a copy and give it to Larry so he knows that there is no way he will ever own it. Then I would fly out of the nest and make a home of my own. I would see if M would like to get an apartment with me, and I would find a job that was not entangled in my mother’s financial and personal affairs. I think it would feel great to be totally independent and self-supporting. I would also be away from the stress of living with two people in a bad relationship.

You would also be honoring your mother by letting her stay in a house that she apparently has lived in for years. Eventually, everything will come crashing down, and you wont be in a desperate situation with them. L will leave for greener pastures and your mother will have a place to live out her senior years in,

Pray, Pray, Pray for God’s will to be made known to you. I think you love your mother and love endures all things. Think of the house as it was originally intended to be, an inheritance for you and your brothers.
 
Yes, all the paperwork does have to be intact! I left that out. I was just referring to the actual transfer of funds. Everything else must be in place under the law as far as the house is concerned. 🙂
 
Second question…did you get the title placed into your name and file the proper paperwork with your County Clerk’s office? You can’t just simply pay someone $10 these days and BAM - get a house.
Unless you have the title of the house properly put into your name and the legal paperwork was completed - I hate to tell ya but the hose is not yours.

Are you paying the property taxes? Are the taxes actually in your name?

I just don’t think you have a leg to stand on. Move out - let your mother make the mistakes she is going to make - just turn and run before they drag you into their credit problems.

Go get a different job too.
YES, It was signed bye a notory, it’s fully in my name. no contracts before…

the only verbal agreement is that my mom would pay the taxes, but even the taxes are in my name…

electricity bill, cable bill, water bill, Internet bill, are all in my name.

All except for the Vonage bill that was recently added.

I’m still having a lot of trouble so prayer would be greatly appreciated if any of you think about it.
