Hi, I need some advise. Sorry if this is long. I ordered some dvds from ioffer. They are burned copies of a tv show that isn’t available to buy yet. I waited almost all of September for delivery, nothing came, so I told the seller and they said they would send a new set immediately. I waited another three weeks until it was the last day I would be able to file a Paypal complaint. So I filed the complaint with Paypal. I waited another week, and after the seller stopped replying to messages, I escalated the complaint to a claim (meaning Paypal looks at the evidence and decides who keeps the money). Well the seller has not responded to the claim, so in three days the refund will automatically go to me. My problem is the dvds arrived yesterday, but some are defective. They all occasionally skip, and one will not fully play (I’ve only watch three of the ten discs so far). So, do I cancel my claim, or take my refund? If the discs worked I would cancel the claim, because if I didn’t, that would be stealing. But the seller has stopped replying to me, and removed all their listings from ioffer. So I don’t know what to do, if I cancel the claim there is no way to contact them and ask for replacement discs, and I’m out $40. Should I take the refund since they are defective, or cancel my claim and lose the money? One choice is unfair to me, the other seems unfair to the seller. What do I do?
