My wife and I are separated and will be seeking divorce. I am Roman Catholic and she is Protestant. She has believed the marriage has been over for years and currently has a boyfriend. I wish to move on with my life, and wish to petition the Church for an annulment. Do I have to obtain a civil decree of divorce before I can do that?

Yes, in the USA a finalized civil divorce is required before the annulment process can begin. This is because the annulment process cannot begin unless there is a clear sign that there is no hope of reconciliation, in the USA a finalized divorce is considered that sign. Secondly, in cases of separation of spouses there is an issue of justice towards the other spouse and any children. A finalized divorce would contain the conditions that fulfill those matters.
