South Bend, IN – The judge in the case concerning the pro-life protesters arrested on the campus of Notre Dame University expressing their opposition to the Catholic college giving an award to pro-abortion President Barack Obama has recused herself after an appeal was filed suggesting a conflict of interest.

I can’t understand how a judge could initially refuse to be taken out of the case. Her husband works for Norte Dame; no matter what his opinions are, the relationship is a conflicit. It would be enough to eliminate her from being on the jury; let alone being the judge.

I think judges, by virtue of their training, like to think that no matter what the circumstances they can be truly unbiased. I think they see it as an attack on their professionalism and integrity to be asked to step aside. So she probably in all reasonableness did not see any issue with her husband being employed by ND and she didn’t see any conflict there. Once the lawsuit came down, to avoid a lot of time and hassle she just decided it easier to step aside rather than fight it. I don’t know if the status or outcome of this lawsuit has been hurt or benefitted at all from having a new judge assigned to it.

This is what gets me. Catholic universities with faculty who advocate for abortion.

This is what gets me. Catholic universities with faculty who advocate for abortion.
I don’t know about other Catholic universities, but that seems to be par for the course for Notre Dame. Does the name Fr. Richard McBrien ring any bells? Probably the most infamous example.

This would be par for the course for those universities that are party to the “Land-O-Lakes” agreement. Notre Dame, St. Louis U, Boston College and quite a few more separated themselves from the teaching authority of the Catholic Church back in the mid-sixties. If you go to their web sites you will see that they identify themselves as “private” schools with a long catholic tradition.
