Lack of Form Exceptions?

We are trying to get a lack of form certificate for my husband’s previous marriage, it was a fixed marriage outside the church. We are having a hard time to get a copy of their marriage certificate since they had it abroad. The family from the previous marriage does not want to cooperate. A copy of the marriage certificate is needed for this to be filed, but what if we could not get one? We have the divorce decree and a copy of my husbands baptismal certificate but not the copy of previous marriage certificate. We are also running out of time since we have scheduled our Church ceremony for Feb 09. Is there an exception or is there a way around it for the lack of form certificate to be processed?

Any help would be appreciated.

Is there a way to get a legal document from the country where the marriage occurred? Or are such records not kept there?

Was your husband baptized as a Catholic? I assume so if you are going for lack of form. Did you get a NEW copy of his baptismal certificate (which should list any Catholic marriages)?

Yes, we do have a recent copy of his baptismal certificate with a notation “For Marriage Purposes Only”, so will this certificate, the approved divorce decree and the lack of form questionnaire be ok for the Tribunal?

This is a question for the Tribunal.

Did you speak to them? The place to start is with your local diocesan officials.

I’m not qualified to answer any kind of legal questions. I wouldn’t know what the tribunal will accept for a lack of form ruling. It’s my understanding that dioceses vary on how much information is required for a lack of form ruling.

Our Parish Priest is helping us with this. Yes, I already talked to the Tribunal but I don’t think they understand. Should I talk to them again? Can I talk to a different Tribunal official other than the judicial vicar? I wonder if there are exceptions to the rule of submitting the form with a marriage certificate?

For this particular question, only a diocesan official can supply the answer about what they will need, accept, require.

You really need to talk to them again, and your priest as well.
