This is more of a curiosity than anything else. I’ve been reading stories of people who survived botched abortions. Many of them suffer ill effects from the abortion attempt (for example, a maimed arm, cerebral palsy, facial disfigurement, etc). In the United States, would an abortion survivor have any legal recourse against an abortion provider for physical problems that the child suffered because of that procedure? I’m not talking about “wrongful birth” arguments (i.e. I’m not saying the argument should be made that the abortion provider is “guilty” because he botched the abortion and the child didn’t die); rather, I’m curious if once a child survives, the child could press a provider (or parent) to take responsibility for the fact that the child no longer has a left arm or the ability to walk.
