The Supreme Court did not want to hear the case and concluded that there is no need to reopen the case even though we pointed out that this involved minority rights & the constitution and have far wider implications than whether a small newspaper with limited circulation can use the word Allah.Did the Supreme Court of Malaysia ignore the evidence, and find some pretext to reach a conclusion dictated by the above political considerations?
It would seem that the judges do not want the embarrassment of having to support a Court of Appeal ruling that they knew was based on very flawed judgement and judicial procedure.
The Court of Appeal ruling involve the judge making his own research on the internet and came to a conclusion that the word Allah is not fundamental to the Christian faith. He did not give us any reference of where he got the research nor did he bring the research back to the court to be examined by the counsels involved to determine admissibility as evidence to support a court judgement.
Needless to say, Malaysian judiciary became the laughing stock when hosting a Commonwealth legal conference a few months later.
